BACKGROUND AND PURPOSE 

Currently, the judges of the 3rd and 173rd district courts serve on the
juvenile board of Henderson County (board).  The 392nd Judicial District
was established in 1995, but it was not included in the statutory
composition of the board.  H.B. 1532 makes the judge of the 392nd Judicial
District a member of the board.  It also provides for the election of a
chairman of the board, modifies language regarding the board members'
compensation, and designates a district attorney with jurisdiction in
Henderson County to act for the county attorney under certain
circumstances. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 152.1131, Human Resources Code, as follows:

Sec. 152.1131.  HENDERSON COUNTY.  (a)  Includes in the composition of the
juvenile board of Henderson County (juvenile board) the judge of the 392nd
Judicial District. The other members of the juvenile board include the
judges of the 3rd and 173rd judicial districts, the county judge, the judge
of the county court at law, and the county attorney.  Makes a conforming
change. 

(b)  Requires the juvenile board to elect one of its members as chairman at
its first regular meeting of each fiscal year, rather than designating the
judge of the 173rd Judicial District as chairman.   

(c)  Requires the commissioners court to pay the 173rd and 392nd district
judges and the county court at law judge an amount set by the commissioners
court at not less than $750 a month.  Requires the commissioners court to
pay the 3rd district judge an amount set by the commissioners court at not
less than one-third of the amount paid to the 173rd or 392nd district judge
or the county court at law judge.  Establishes that the compensation is in
addition to other compensation provided or allowed by law, rather than
provided or allowed for a county attorney.  Makes conforming and
nonsubstantive changes.   

(d)  Requires a district attorney with jurisdiction in Henderson County,
rather than the district attorney for the 173rd Judicial District, to act
for the county attorney at the request of the juvenile court judge if the
county attorney is ill or unable to perform the duties of the county
attorney.   

(e)  Deletes existing text which designates the 173rd District Court as the
juvenile court of Henderson County.  Makes a conforming change. 

SECTION 2.  Effective date: September 1, 1999.

SECTION 3.  Emergency clause.
