HBA-JRA H.B. 1570 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1570 By: Grusendorf Public Education 3/10/1999 Introduced BACKGROUND AND PURPOSE Currently, Texas has its own K-12 curriculum and assessment system and is in the process of linking it to teacher preparation and certification. A teacher certification process based on national guidelines may diminish the progress Texas is making in linking teacher preparation, certification, and curriculum requirements. H.B. 1570 prohibits the State Board for Educator Certification from requiring any national credential for certification as an educator in this state. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that rulemaking authority previously delegated to the State Board for Educator Certification is modified in SECTION 1 (Section 21.041, Education Code) and SECTION 2 (Section 21.048, Education Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 21.041, Education Code, by adding Subsection (d), as follows: (d) Prohibits the State Board for Educator Certification (board) from requiring any national credential for certification in this state, when proposing rules under Subsection (b) specifying the classes of educator certificates. SECTION 2. Amends Section 21.048(a), Education Code, to prohibit the board from requiring a standardized, national certification examination for any class of certificate. SECTION 3. Emergency clause. Effective date: upon passage.
