HBA-JRA H.B. 1582 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1582 By: Salinas Public Education 3/12/1999 Introduced BACKGROUND AND PURPOSE Professional classroom teachers, as part of their current job responsibilities, provide daily classroom course instruction, grade papers, prepare daily classroom lesson plans, conduct regular parent-teacher conferences and plan and conduct non-instructional classroom activities. State-mandated student testing requirements and related paperwork add to the amount of time spent on routine clerical work. Increasingly, teachers are being required to attend and monitor functions that are not directly related to their traditional classroom duties, such as school board meetings, athletic events, and city council or county commissioners court meetings. H.B. 1582 prohibits school districts from requiring teachers to attend more than one school-related meeting or other activity each week, beyond the regular teacher work day, without compensation. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter I, Chapter 21, Education Code, by adding Section 21.4031, as follows: Sec. 21.4031. COMPENSATION FOR LONGER WORK DAY. Prohibits a school district from requiring a teacher to attend more than one school-related meeting or other activity each week beyond the regular teacher work day without compensation for the time spent on the activity based on a proportionate amount of the teacher's daily rate of pay. Establishes that a teacher's daily rate of pay is the quotient of the teacher's salary for a school year divided by the number of days of service for that year. SECTION 2. Makes application of this Act prospective to the 1999-2000 school year. SECTION 3.Emergency clause. Effective date: upon passage.
