HBA-MPM H.B. 1615 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 1615 By: Uher Higher Education 7/20/1999 Enrolled BACKGROUND AND PURPOSE Section 51.9335, Education Code, as added by the 74th Legislature, authorized procurement utilizing "best value" criteria and several competitive and negotiated procurement methods for medical and dental units. This section expires September 1, 1999. The University of Texas System's medical and dental units have saved money when purchasing commodities and services since the implementation of this section. H.B. 1615 removes the September 1, 1999, expiration date, thereby allowing Section 51.9335 to remain in effect. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Section 51.9335(f) (Acquisition of Goods and Services), Education Code. This subsection provides the expiration date of September 1, 1999, for the section, which sets forth methods and considerations under which medical and dental units may acquire goods or services. SECTION 2. Emergency clause. Effective date: upon passage.
