In 1993, the guardianship and probate provisions of the Probate Code were
separated. Provisions relating to guardianships were added in newly
created Section 745. Provisions containing the same language created in
Section 745 were left in Section 404. H.B. 1660 would delete language
making applicable to guardianships and the estates of deceased wards.
PURPOSE
As proposed, H.B. 1660 deletes language making Section 404, Texas Probate
Code, applicable to guardianships and the estates of deceased wards.
RULEMAKING AUTHORITY
This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 404, Probate Code, as follows:
Sec. 404. New heading: CLOSING ADMINISTRATION OF ESTATES OF DECEDENTS.
Deletes text regarding the guardianship of wards or their estates.
SECTION 2. Emergency clause.
Effective date: upon passage.
