DIGEST 

In 1993, guardianship and probate provisions under the Probate Code were
separated. Provisions regarding guardianships were added under the newly
created Section 750, Probate Code; however, provisions containing the same
language created under Section 750, Probate Code, were left in Section 406,
Probate Code. H.B. 1661 would delete existing language regarding
guardianships and the estates of deceased wards from Section 406, Probate
Code.  

PURPOSE

As proposed, H.B. 1661 deletes language regarding guardianships and estates
of deceased wards from Section 406, Probate Code.  

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 406, as amended by Chapters 898 and 957, Acts of
the 73rd Legislature, 1993, to delete text regarding complaints filed by
anyone interested in the estate of a deceased ward or whose whereabouts are
unknown, and to whom rentals or payments are due to the ward or estate.
Makes conforming and nonsubstantive changes. 

SECTION 2. Makes application of this Act prospective.

SECTION 3. Effective date: September 1, 1999.

SECTION 4. Emergency clause.
