HBA-ATS, KMH H.B. 1662 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 1662 By: Naishtat Judicial Affairs 6/3/1999 Enrolled BACKGROUND AND PURPOSE In 1993, the guardianship and probate provisions of the Texas Probate Code were separated. Provisions relating to guardianships were added in newly created sections in the code, but provisions containing the same language were left in Part 10 (Investments, Loans, and Contributions of Estates of Wards), Chapter VIII, Texas Probate Code. H.B. 1662 repeals Part 10, thereby eliminating the duplication. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Part 10 (Investments, Loans, and Contributions of Estates of Wards), Chapter VIII, Texas Probate Code. SECTION 2. Emergency clause. Effective date: upon passage.
