DIGEST 

Currently, Section 152.0241, Human Resources Code, sets forth three
separate juvenile boards for Bosque, Comanche, and Hamilton counties. These
three counties compose the 220th Judicial District, and share a single
district judge. The administration of the juvenile program is conducted
jointly. The three counties are represented by their respective county
judges who work in conjunction with the 220th district judge. H.B. 1723
would create a single juvenile board for the Bosque, Comanche, and Hamilton
counties, set forth membership for the juvenile board, and clarify
compensation of the board members.   

PURPOSE

As proposed, H.B. 1723 sets forth provisions regarding juvenile boards in
the Bosque, Comanche, Hamilton counties. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 152.0241, Human Resources Code, as follows: 

Sec. 152.0241. BOSQUE COUNTY. (a) Provides that Bosque County is included
in the Bosque, Comanche, and Hamilton counties juvenile board (juvenile
board). Provides that the juvenile board is composed of the county judge in
Bosque County, the county judge in Comanche County, the county judge in
Hamilton County, and the 220th Judicial District Judge, rather than the
district judges in Bosque County. Deletes text regarding Bosque County. 

(b) Provides that the 220th Judicial District judge is the chairman of the
board and its chief administrative officer.  

(c) Requires the commissioners court of Bosque County to pay the county
judge in Bosque County and the 220th Judicial District judge, rather than
juvenile board members, additional annual compensation set by the
commissioners court at no less than the amount paid to a board member under
this section on October 1, 1998. Deletes text regarding more than $1,200
for the added duties imposed on the members. 

(d) Provides that Section 152.0008(a), does not apply to the juvenile board
of Bosque County. Deletes text regarding Sections 152.0003 and 152.0005.
Makes conforming changes. 

SECTION 2. Amends Section 152.0531, Human Resources Code, as follows: 

Sec. 152.0531. COMANCHE COUNTY. (a) Provides that Comanche County is
included in the Bosque County, and Hamilton counties juvenile board.
Provides that the juvenile board is composed of the county judge in Bosque
County, the county judge in Comanche County, the county judge in Hamilton
County, and the 220th Judicial District judge, rather than the district
judges in Comanche County. Deletes text regarding Comanche County. 
 
(b) Provides that the 220th Judicial District judge, rather than juvenile
court judge, is the chairman of the board and its chief administrative
officer. 

(c) Requires the commissioners court of Comanche County to pay the county
judge in Comanche County and the 220th Judicial District judge, rather than
juvenile board members, additional annual compensation set by the
commissioners court at no less than the amount paid to a board member under
this section on October 1, 1998. Deletes text regarding  $1,000 for the
added duties imposed on the members. 
 
 (d) Makes conforming changes.

SECTION 3. Amends Section 152.1031, Human Resources Code, as follows: 

Sec. 152.1031. HAMILTON COUNTY. (a) Provides that Hamilton County is
included in the Bosque, Comanche, and Hamilton counties juvenile board.
Provides that the juvenile board is composed of the county judge in Bosque
County, the county judge in Comanche County, the county judge in Hamilton
County, and the 220th Judicial District judge, rather than the district
judges in Hamilton County. Deletes text regarding Hamilton County. 

(b) Provides that the 220th Judicial District judge, rather than juvenile
court judge, is the chairman of the board and its chief administrative
officer.  

(c) Requires the commissioners court of Hamilton County to pay the county
judge in Hamilton County and the 220th Judicial District judge, rather than
juvenile board members, additional annual compensation set by the
commissioners court at no less than the amount paid to a board member under
this section on October 1, 19998. Deletes text regarding $1,200 for the
added duties imposed on the members. 
 
 (d) Makes conforming changes.

SECTION 4. Emergency clause.
           Effective date: upon passage.
