DIGEST 

Currently, the Texas Animal Health Commission requires all horses changing
ownership in Texas to test negative for equine infectious anemia within the
previous twelve months, except for horses sold at auction.  H.B. 1732 would
establish conditions regarding the testing of certain equine animals for
equine infectious  anemia; providing a criminal penalty. 

PURPOSE

As proposed, H.B. 1732 establishes conditions regarding the testing of
certain equine animals for equine infectious  anemia; providing a criminal
penalty. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 161H, Agriculture Code, by adding Section
161.149, as follows: 

Sec. 161.149.  TEST FOR EQUINE INFECTIOUS ANEMIA.  Defines "equine animal."
Provides that a person commits an offense if the person transfers ownership
of an equine animal eight months of age or older that has not tested
negative for equine infectious anemia during the 12 months preceding the
date of the transfer, unless certain conditions exist regarding the equine
animal.  Establishes that an offense under Subsection (b) is a Class C
misdemeanor unless it is shown that the defendant has been convicted for
the same offense before, then the offense is a Class B misdemeanor. 

SECTION 2.  Effective date: September 1, 1999.

SECTION 3.  Makes application of this Act prospective.

SECTION 4.  Emergency clause.
