HBA-RBT H.B. 1790 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1790 By: Lewis, Ron Natural Resources 4/16/1999 Introduced BACKGROUND AND PURPOSE Currently, navigation districts are subject to a variety of restrictions including prohibitions on soliciting proposals and requirements regarding design, construction, and hiring of contractors. H.B. 1790 clarifies existing law regarding purchasing procedures available to navigation districts to construct or repair facilities. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 62, Water Code, by adding Subchapter I, as follows: SUBCHAPTER I. PURCHASES CONTRACTS Sec. 62.350. PURCHASING CONTRACTS. Authorizes district contracts valued at $25,000 or more in the aggregate for each 12-month period to be made by any of the methods available to school districts under Chapter 44 (Fiscal Management), Subchapter B, Education Code, that provides best value to the district. SECTION 2. Emergency clause. Effective date: 90 days after adjournment.
