HBA-JRA H.B. 1845 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1845 By: Swinford Agriculture & Livestock 3/10/1999 Introduced BACKGROUND AND PURPOSE Currently, all marketing associations chartered under Chapter 52 (Cooperative Marketing Associations), Agriculture Code, provide each member of the association with one vote. Several years ago, the citrus marketing associations of Texas adopted a system providing some members with more than one vote according to the amount of business each member contributes to the marketing association. H.B. 1845 authorizes marketing associations organized primarily for grain markets to provide member associations with more than one vote per member. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 52.085(b), Agriculture Code, to include an association organized primarily for the harvesting, preserving, drying, processing, canning, storing, handling, shipping, marketing, selling, or use of grain or grain-related products among the member associations which a marketing association may provide with more than one vote. Redesignates existing Subdivisions (2)-(3) to Paragraphs (1)(A)-(1)(B). Makes conforming changes. SECTION 2.Emergency clause. Effective date: upon passage.
