HBA-MPA H.B. 1871 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1871 By: Wilson Transportation 4/20/1999 Introduced BACKGROUND AND PURPOSE Robert Mueller Airport has existed in the Austin area for many years and has provided quality service. It is located in the city of Austin and has adequate roads surrounding its facility. H.B. 1871 allows those airlines wishing to continue service from Robert Mueller Airport to do so. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter Z, Chapter 22, Transportation Code, to require a municipality that operates an airport to allow each commercial airline that serves the airport the option to continue service to that airport if the municipality opens a new airport farther from the central business district than the existing airport. Requires the municipality to continue to operate the existing airport if a commercial airline elects to continue providing service to that airport. SECTION 2. Provides that Section 22.902, as added by this Act, applies only to an airport opened by a municipality on or after January 1, 1999. SECTION 3.Emergency clause. Effective date: upon passage.
