DIGEST 

Currently, the installation, repair, or removal of certain types of vent
hoods is covered under the Air Conditioning and Refrigeration Contractor
License Law (Article 8861, V.T.C.S.). As the statute is written now, the
installation, repair, or removal of a vent hood in any location other than
one's home must be completed by a licensed air conditioning and
refrigeration contractor. Requiring such a procedure to be performed by a
licensed air conditioning and refrigeration specialist is unnecessary and
costly to consumers.  H.B. 1997 would remove the procedure of installation,
repair, or removal of vent hoods from the purview of the Air Conditioning
and Refrigeration Contractor License Law.  

PURPOSE

As proposed, H.B. 1997 removes the procedure of installation, repair, or
removal of vent hoods from the purview of the Air Conditioning and
Refrigeration Contractor License Law. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 6, Article 8861, V.T.C.S., by adding Subsection
(h), to provide that this Act does not apply to a person who installs,
repairs, or removes a vent hood of the type commonly used in residential
and commercial kitchens. 

SECTION 2. Effective date: immediately, and makes application of this Act
prospective. 

SECTION 3.Emergency clause.
  Effective date: upon passage.
