SRC-JBJ C.S.H.B. 2021 76(R)BILL ANALYSIS Senate Research CenterC.S.H.B. 2021 By: Janek (Lindsay) Education 5/13/1999 Committee Report (Substituted) DIGEST Currently, purchases made by large school districts may not benefit from Subchapter F, Education Code (District-Level and Site-Based Decision-Making) because the sum of many independent purchasing decisions may exceed the $25,000 threshold. The threshold requires the use of district-wide purchasing procedures set forth in Chapter 44, Education Code (Fiscal Management). C.S.H.B. 2021 would amend Chapter 44, Education Code, to provide that the $25,000 threshold be applied to campus-level, rather than district-level, purchases, provided that the school has adopted a site-based, decision-making plan to decentralize those purchases to the campus level. PURPOSE As proposed, C.S.H.B. 2021 amends regulations regarding the requirements for purchasing in school districts that adopt site-based decision-making plans. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 44.031, Education Code, by adding Subsection (m), to make this section applicable only to campuses with an average daily attendance of 190,000 or more and that have adopted a site-based, decision-making plan under Chapter 11F, if a purchase is made at the campus level in a school district that has formally adopted a site-based decision making plan that delegates purchasing decision to the campus level. SECTION 2. Amends Section 44.033, Education Code, by adding Subsection (e), to make this section applicable only to campuses with an average daily attendance of 190,000 or more and that have adopted a site-based, decision-making plan under Chapter 11F, if a purchase is made at the campus level in a school district that has formally adopted a site-based decision making plan that delegates purchasing decision to the campus level. SECTION 3.Emergency clause. Effective date: upon passage.
