DIGEST 

Currently, the Texas Commission on Law Enforcement Officer Standards and
Education (TCLEOSE) employs investigators to examine license candidates and
complaints against licensees. TCLEOSE investigators, who are not
commissioned officers, may be called upon to investigate commissioned
officers.  H.B. 2023 would create authority for the Commission on Law
Enforcement Officer Standards and Education to employ and commission peace
officers. 

PURPOSE

As proposed, H.B. 2023 creates authority for the Commission on Law
Enforcement Officer Standards and Education to employ and commission peace
officers. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Subchapter A, Chapter 415, Government Code, by adding
Section 415.016, as follows: 

Sec. 415.016. AUTHORITY TO COMMISSION INVESTIGATORS AS PEACE OFFICERS.
Authorizes the Commission on Law Enforcement Officer Standards and
Education (TCLEOSE) to commission certified peace officers and
investigators employed by TCLEOSE for the limited purpose of assisting
TCLEOSE in administering this chapter.  

SECTION 2.  Amends Article 2.12, Code of Criminal Procedure, to include
investigators commissioned by TCLEOSE under Section 415.016, Government
Code, among those that are peace officers. Makes conforming changes. 

SECTION 3.Emergency clause.
  Effective date: upon passage.
