Current law exempts counties with a population over 500,000 from the
requirement to hold a public hearing and publish notice in the newspaper
before adopting certain traffic regulations. H.B. 2034 exempts counties
with a population of more than 200,000, rather than 500,000, from the
requirements of Section 251.159, Transportation Code, relating to the
commissioners court's authorized procedures in lieu of publishing notice
and holding public hearings.
PURPOSE
As proposed, H.B. 2034 authorizes certain counties to delegate traffic
regulations.
RULEMAKING AUTHORITY
This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 251.159(a), Transportation Code, to provide that
this section applies only to a county with a population of more than
200,000, rather than 500,000.
SECTION 2. Emergency clause.
Effective date: upon passage.
