HBA-LCA H.B. 2132 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2132 By: Garcia Public Education 4/21/1999 Introduced BACKGROUND AND PURPOSE H.B. 2132 provides that portions of campus report cards disseminated to the parent or other person having lawful control over a student must include information concerning the student's performance. This bill also provides that portions of a report card relating to a high-school campus include information on students who started high school at the campus and dropped out of school before graduating. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that rulemaking authority is expressly delegated to the commissioner of education in SECTION 2 and that rulemaking previously delegated to the commissioner of education is modified in SECTION 1 (Section 39.052, Education Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 39.052(c), Education Code, to delete guardian and conservator, thus leaving the parent and a person having lawful control of each student at the campus, as persons for whom the commissioner of education (commissioner) is required to adopt rules requiring dissemination of appropriate student performance portions of campus report cards annually. Provides that portions of campus report cards disseminated to the parent or other person having lawful control over a student must include information concerning the student's performance under Sections 39.051 (b) (1)-(8) (Academic Excellence Indicators). Provides that portions of a report card relating to a high-school campus include information on students who started high school at the campus and dropped out of school before graduating in the most recent three-year or four-year period. SECTION 2. Requires the commissioner to adopt rules in accordance with Section 39.052(c), Education Code, in accordance with this Act. Provides that those rules apply with the beginning of the 2000-2001 school year. SECTION 3. Emergency clause. Effective date: upon passage.
