HBA-DMD H.B. 2160 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2160 By: Bosse Public Safety 4/16/1999 Introduced BACKGROUND AND PURPOSE Currently, law enforcement officers from small municipalities in parts of Harris County cannot apply to enforce federal transportation laws relating to vehicle weight limits. H.B. 2160 makes a police officer of a municipality with a population less than 25,000, with certain restrictions, eligible to apply for certification in order to enforce commercial motor vehicle safety standards. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 644.101(b), Transportation Code, to include among existing municipalities where a police officer is eligible to apply for certification under this section (Certification of Municipal Peace Officers), a municipality with a population of less than 25,000, any part of which is located in a county with a population of 2.4 million and that contains or is adjacent to an international port. Makes conforming changes. SECTION 2. (a) Provides that in accordance with Section 311.031(c), Government Code, which gives effect to a substantive amendment enacted by the same legislature that codifies the amended statute, the text of Section 644.001(b), Transportation Code, as set out in this Act, gives effect to changes made by Chapters 364 and 1061, Acts of the 75th Legislature, Regular Session, 1997. (b) Provides that to the extent of any conflict, this Act prevails over another Act of the 76th Legislature, Regular Session, 1999, relating to nonsubstantive additions and corrections in enacted codes. SECTION 3.Emergency clause. Effective date: upon passage.
