BACKGROUND AND PURPOSE 

Currently, employees of four year institutions of higher education may
request a payroll deduction for membership dues in a professional
organization.  Community college employees, however, do not have this
option.  H.B. 2167 allows an employee of a junior college district to
authorize a payroll deduction for a contribution to a professional
organization, as well as to revoke this authorization. This bill also
authorizes a junior college district to charge an employee who authorizes a
deduction a fee to cover administrative costs.   

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Subchapter A, Chapter 130, Education Code, by adding
Section 130.010, as follows: 

Sec. 130.010.  VOLUNTARY SALARY DEDUCTIONS FOR PROFESSIONAL ORGANIZATIONS.
(a)  Authorizes an employee of a junior college district (district), on a
form prescribed by the district, to authorize a payroll deduction for a
contribution to a professional organization (organization).  Provides that
the authorization must provide specific information regarding the deducted
amount and direct the chief financial officer of the district (financial
officer) to transfer the funds to the designated organization.  Provides
that the deduction must be accomplished in a manner prescribed by the
financial officer. Authorizes the employee to change or revoke the
authorization by delivering written notice on a form prescribed by the
district to the financial officer.  Provides that this notice is effective
on the later of the effective date specified in the notice or the date the
financial officer receives it.  Provides the notice must be delivered in a
manner prescribed by the financial officer.  Authorizes a district to
charge an administrative fee to an employee who authorizes a deduction
under this section which may not exceed the actual administrative cost or
the fee the district charges for other salary deductions. 

SECTION 2.Emergency clause.
  Effective date:  90 days after adjournment.
