HBA-KMH H.B. 2193 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2193 By: Wise Criminal Jurisprudence 4/15/1999 Introduced BACKGROUND AND PURPOSE Currently, the possession or promotion of child pornography is a felony of the third degree. H.B. 2193 raises the offense of possession or promotion of child pornography to a felony of the second degree if the visual material is an image transmitted to a computer by telephone line, cable, satellite transmission, or other method. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 43.26(d) and (g), Penal Code, to increase the punishment for possession or promotion of child pornography from a felony of the third degree to a felony of the second degree if the visual material is an image transmitted to a computer by telephone line, cable, satellite transmission, or other method. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
