SRC-DPW H.B. 2196 76(R) BILL ANALYSIS Senate Research Center H.B. 2196 76R6009 JMC-DBy: Hope (Bernsen) Jurisprudence 5/7/1999 Engrossed DIGEST Currently, Montgomery County is experiencing growth in population and the county attorney's office is inundated with misdemeanor criminal offense cases. This bill would transfer the responsibility of prosecution of all criminal misdemeanor cases in Montgomery County to the district attorney. PURPOSE As proposed, H.B. 2196 sets forth duties of the district attorney for the 9th Judicial District. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 43.105, Government Code, to require the district attorney of the 9th Judicial District to represent the state in misdemeanor criminal cases pending in the district and inferior courts of Montgomery County. Makes conforming changes. SECTION 2. Effective date: January 1, 2001. SECTION 3. Emergency clause.
