BACKGROUND AND PURPOSE 

Montgomery County is experiencing growth in population and the county
attorney's office has been inundated with misdemeanor criminal offenses.
H.B. 2196 transfers the responsibility of prosecution of all criminal
misdemeanor cases in Montgomery County to the district attorney. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 43.105, Government Code, to require the district
attorney to represent the state in misdemeanor criminal cases pending in
the district and inferior courts of Montgomery County.  Redesignates
Subsections (b)-(g) to Subsections (c)-(h), respectively. 

SECTION 2.  Effective date: January 1, 2001.

SECTION 3.  Emergency clause.
