DIGEST 

Currently, the Parks and Wildlife Code restricts the possession of live
game animals, with certain exceptions.  A person in possession of a game
animal who cannot produce a license or permit authorizing such possession,
violates Section 63.002, Parks and Wildlife Code, but no penalty exists for
the violation.  This bill would establish a penalty for violation of
Section 63.002, Parks and Wildlife Code. 

PURPOSE

As proposed, H.B. 2303 defines the penalty for possession of a live game
animal. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 63.104, Parks and Wildlife Code, by amending
Subsection (b) and adding Subsection (c), to provide that a person who
violates Section 63.002 of this code commits a Class C offense and a
Wildlife Code misdemeanor.  Deletes text regarding violation of Section
63.007 of this code. 

SECTION 2. Effective date: September 1, 1999.

SECTION 3. Makes application of this Act prospective.

SECTION 4. Emergency clause.
