BACKGROUND AND PURPOSE 

The Texas Workforce Commission has undertaken an overhaul of the Labor
Exchange System, which is the database that serves the employer services
division by matching employers with qualified applicants. This project will
be an Internet interface that will be accessible to local boards, employers
and job seekers. C.S.H.B. 2487 creates a committee to provide input with
respect to the implementation of the labor exchange system and sets forth
necessary procedures and duties of the committee to ensure implementation. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 307, Labor Code, by adding Subchapter B, as
follows: 

SUBCHAPTER B.  LEGISLATIVE OVERSIGHT

Sec. 307.051.  DEFINITIONS.  Defines "committee" and "labor exchange
system."   

Sec. 307.052.  COMPOSITION OF COMMITTEE; PRESIDING OFFICER.  Provides that
the labor exchange system employer advisory committee is composed of nine
members.  Sets forth the composition of the committee and provides that a
member of the committee serves at the will of the appointing official.
Requires the governor to designate the presiding officer of the committee
from the membership of the committee.  Provides that the presiding officer
serves in that capacity for a two-year period expiring February 1 of each
odd-numbered year. 

Sec. 307.053.  COMMITTEE POWERS AND DUTIES.  Requires the committee to meet
at the call of the presiding officer and to review the design of any
proposed improvements to the labor exchange system by the Texas Workforce
Commission (commission) as necessary to ensure certain system requirements.
Requires the committee to provide input to the commission regarding the
ongoing implementation of the labor exchange system to ensure certain
system requirements and requires the committee to oversee the development
of performance standards for the system.  Requires the committee to monitor
trends described by this section and evaluate those trends against
performance standards and customer satisfaction.  Authorizes the committee
to request reports and other information from the commission and other
state agencies as necessary to carry out its duties under this section. 

Sec. 307.054.  REPORTS.  Requires the committee to report to the governor
on the results of the committee's activities and provides that the report
must include any recommendations for legislative action.  

SECTION 2.  Redesignates Sections 307.001, 307.002, and 307.003, Labor
Code, as  Subchapter A, Chapter 307, Labor Code. 
 
SECTION 3.  Adds a heading for Subchapter A, Chapter 307, Labor Code, as
follows: 

New title: SUBCHAPTER A.  OPERATION OF EMPLOYMENT SERVICE

SECTION 4.  Effective date: September 1, 1999.

SECTION 5.  Emergency clause.

COMPARISON OF ORIGINAL TO SUBSTITUTE

C.S.H.B. 2487 modifies the original in SECTION 1(proposed Section 307.052,
Labor Code) by providing that the committee is composed of nine members
appointed by the governor, rather than eight members appointed by the
lieutenant governor and the speaker of the house of representatives, and by
requiring the governor, rather than the lieutenant governor and the speaker
of the house of representatives on an alternating basis, to designate the
presiding officer of the committee from the membership of the committee. 

C.S.H.B. 2487 modifies the original in SECTION 1(proposed Section 307.053,
Labor Code) by requiring  the committee to review any proposed improvements
to the labor exchange system,  rather than oversee the design of any a
technologically advanced labor exchange system by the Texas Workforce
Commission (commission) as necessary to ensure certain system requirements.
The substitute modifies the original by requiring  the committee to provide
input to the Texas Workforce Commission regarding the implementation and
expansion of the labor exchange system by the commission. The original bill
required the committee to oversee the implementation of the system. The
substitute deletes proposed text requiring the committee to use the
existing staff resources of the senate and the house of representatives to
assist the committee in performing its duties under this section. 

C.S.H.B. 2487 modifies the original in SECTION 1(proposed Section 307.054,
Labor Code) by requiring the committee to report to the only governor,
rather than the governor, lieutenant governor and speaker of the house of
representatives,  on the results of the committee's activities and provides
that the report must include any recommendations for legislative action.
