DIGEST 

A law passed by the 75th Legislature removed a requirement that a court
dismiss a charge for failure to maintain financial responsibility for a
vehicle, with an affirmative defense to prosecution if a person provides
documents proving financial responsibility at the time of the offense.  It
was discovered that the old procedure was more efficient.  H.B. 2535
reinstates the old procedure by creating justification for the dismissal of
a charge involving the failure to maintain financial responsibility for a
motor vehicle, relating to the production of a certain document to the
court. 

PURPOSE

As proposed, H.B. 2535 creates justification for the dismissal of a charge
involving the failure to maintain financial responsibility for a motor
vehicle, relating to the production of a certain document to the court. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 601.193, Transportation Code, to provide that a
defense consists of a certain document produced to the court.  Requires the
court to dismiss the charge subsequent to verification of a document. 

SECTION 2.  Effective date:  September 1, 1999.
  Makes application of this Act prospective.

SECTION 3.  Emergency clause.
