DIGEST 

Currently, a municipality with a population of 250,000 or less owning land
within 5,000 feet of a lake may sell the land to the current lessee without
notice or solicitation of funds.  The City of San Angelo is in the process
of selling lots on Lake Nasworthy. H.B. 2572 provides that property sold by
the municipality under this Subsection is not eligible for and the owner is
not entitled to the exemption provided by Section 11.142(a), Water Code, to
protect the public health, safety, or welfare and to ensure an adequate
municipal water supply. 

PURPOSE

As proposed, H.B. 2572 provides that property sold by the municipality is
not eligible for and the owner is not entitled to the exemption provided by
Section 11.142(a), Water Code, to protect the public health, safety, or
welfare and to ensure an adequate municipal water supply. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 272.001(h), Local Government Code, to provide
that property sold by the municipality under this subsection is not
eligible for and the owner is not entitled to the exemption provided by
Section 11.142(a), Water Code, to protect the public health, safety, or
welfare and to ensure an adequate municipal water supply. Requires the
instrument conveying property under this subsection to include a provision
stating that the exemption does not apply to the conveyance.  
SECTION 2. Emergency clause.
  Effective date: upon passage.
