SRC-JJJ H.B. 2636 76(R) BILL ANALYSIS Senate Research Center H.B. 2636 76R2000 JMM-DBy: Gray (Carona) Health Services 5/10/1999 Engrossed DIGEST Currently, the Texas Department of Health (TDH) is authorized to establish a registry for persons who are required to comply with certain portions of the Medical Radiologic Technologist Certification Act. According to an attorney general opinion, under current law TDH may not collect a fee to add people to this registry. H.B. 2636 would establish conditions regarding the assessment of certain fees on persons who perform radiologic procedures. PURPOSE As proposed, H.B. 2636 assesses certain fees on persons who perform radiologic procedures. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2.09, Article 4512m, V.T.C.S., (Medical Radiologic Technologist Certification Act) by amending Subsection (d) and adding Subsection (e), to authorize the Texas Board of Health to set certain fees, including fees to register a person required to comply with mandatory training guidelines, or to process an application for a hardship exemption from the registration requirement. Makes conforming and nonsubstantive changes. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
