HBA-DMD H.B. 2707 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2707 By: Coleman Human Services 3/22/1999 Introduced BACKGROUND AND PURPOSE Under current law, the Texas Department of Protective and Regulatory Services (department) is authorized to pay funeral expenses for a child for whom the department has managing conservatorship and who dies while in foster care. Often the department requests local governments, including child welfare boards, to pay these expenses. H.B. 2707 requires the department to spend funds that are appropriated for the child protective services program to pay the funeral expenses for a child for whom the department has been appointed managing conservator and who dies in foster care. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 264.012, Family Code, to require, rather than authorize, the Department of Protective and Regulatory Services (department) to spend funds appropriated for the child protective services program to pay reasonable and necessary funeral expenses for a child for whom the department has been appointed managing conservator and who dies in foster care. SECTION 2.Effective date: September 1, 1999. SECTION 3.Emergency clause.
