HBA-MPM, JRA C.S.H.B. 2724 76(R)BILL ANALYSIS Office of House Bill AnalysisC.S.H.B. 2724 By: Pickett Juvenile Justice and Family Issues 3/28/1999 Committee Report (Substituted) BACKGROUND AND PURPOSE Currently, the juvenile board of El Paso County is composed of the county judge, the county's family district court judges and juvenile court judges, and up to five judges serving on the El Paso Council of Judges. The Texas Judicial Council and its Committee on Juvenile Justice Reform/Impact on the Courts have recommended that the membership of juvenile boards should be expanded. They propose that judges from other local courts having jurisdiction over juveniles should be included on the board in order to permit all of the courts with jurisdiction over juveniles to work together to address juvenile crime. C.S.H.B. 2724 adds to the El Paso County Juvenile Board (board) a municipal judge of the city of El Paso and a justice of the peace in El Paso County, both of which are selected by the chairman of the juvenile board. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 152.0771(a), Human Resources Code, to add to the juvenile board of El Paso County a municipal judge from El Paso and a justice of the peace in El Paso County, both of which are selected by the chairman of the juvenile board of El Paso County. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause. COMPARISON OF ORIGINAL TO SUBSTITUTE The substitute modifies the original bill in SECTION 1 by modifying proposed Subdivisions (a)(5) and (6) of Section 152.0771, Human Resources Code, as follows: (5) Provides that the juvenile board of El Paso County is includes a municipal judge from El Paso County, selected by the chairman of the juvenile board of El Paso County, rather than the presiding municipal judge from that county. (6) Provides that the juvenile board of El Paso County includes a justice of the peace in El Paso County, selected by the chairman of the juvenile board of El Paso County, rather than a justice of peace selected by a majority vote of all justices of peace in the county.
