HBA-KMH H.B. 2725 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2725 By: Pickett Criminal Jurisprudence 4/19/1999 Introduced BACKGROUND AND PURPOSE H.B. 2725 requires an officer collecting fees for the execution or processing of a warrant or the issuance of a written notice to appear to refund the fees to the defendant upon the defendant's acquittal or dismissal of the charge. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 102.011, Code of Criminal Procedure, to require an officer collecting fees for the execution or processing of a warrant or the issuance of a written notice to appear to refund the fees to the defendant upon the acquittal of the defendant or dismissal of the charge. Requires the officer to return the fee within 10 days of the date the prosecution is barred by the statute of limitations. Makes conforming and nonsubstantive changes. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
