HBA-ALS H.B. 2732 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2732 By: Denny Land & Resource Management 4/5/1999 Introduced BACKGROUND AND PURPOSE Under the Texas Aggregate Quarry and Pit Safety Act, a county with a population of 2.4 million or more may adopt regulations requiring the placement of signs or barriers on aggregate quarries and pits. There is some concern that rural residents in Denton County, are being affected by the encroachment of the quarry operations in that area. H.B. 2732 allows a county that meets certain population requirements to adopt regulations for aggregate quarries or pits as long as they are not inconsistent with state law. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 133.091, Chapter 133, Natural Resources Code, by adding Subsection (b), as follows: (b) Authorizes a county with a population of 270,000 or more and which is adjacent to two or more counties with a population of one million or more, to adopt regulations for aggregate quarries or pits that are not inconsistent with this chapter (Quarry Safety) and Section 133.093 (Conflict With Commission Rule), Natural Resources Code. SECTION 2.Effective date: September 1, 1999. SECTION 3.Emergency clause.
