DIGEST 

Currently, the General Services Commission is authorized to grant easements
and rights-of-way as the needs of certain projects dictate, but is not
authorized to grant licenses, franchises, or use joint use agreements.
This bill would authorize the commission to grant licenses, franchises and
use joint use agreements. 

PURPOSE

As proposed, H.B. 2735 authorizes the General Services Commission to grant
certain interests in certain real property owned by the state. 

RULEMAKING AUTHORITY

This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency. 

SECTION BY SECTION ANALYSIS

SECTION 1. Amends Section 2166.056, Government Code, as follows:

Sec. 2166.056. GRANT OF EASEMENT, FRANCHISE, LICENSE, OR RIGHT-OF-WAY;
JOINT USE AGREEMENTS. Authorizes the General Services Commission
(commission) to grant a franchise or license over and on the land of a
state agency on a project administered by the commission or enter into a
joint use agreement regarding the land, at the commission's discretion if
the commission determines that such action is in the best interest of the
state and if adequate consideration is received by the state under such
action.  Makes conforming changes. 

SECTION 2.Emergency clause.
  Effective date: upon passage.
