HBA-MPM H.B. 2799 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 2799 By: Driver Higher Education 4/5/1999 Introduced BACKGROUND AND PURPOSE H.B. 2799 designates the week of September 24-30 of each year as "Date Rape Awareness Week" at all general academic teaching institutions, including senior colleges and universities. This bill also requires each institution to provide information to recently-enrolled freshmen to increase awareness of the occurrence of date rape and issues related to sexual assault, and requires that if freshmen are required to attend an orientation session, the information must be presented at that time. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter Z, Chapter 51, Education Code, by adding Section 51.9191, as follows: Sec. 51.9191. DATE RAPE AWARENESS WEEK. (a) Defines "general academic teaching institution" (institution) for purposes of this section. (b) Designates the week of September 24-30 of each year as date rape awareness week at institutions. (c) Requires each institution to provide information to all recently enrolled freshmen to increase awareness of the occurrence of date rape, measures for preventing date rape, services available to victims of date rape, and other related sexual assault issues no later than September 30 of each year. Requires the information to be provided at an orientation session if freshmen are required to attend an orientation or in the form of a brochure if freshmen are not required to attend an orientation. (d) Authorizes an institution to provide the information described by Subsection (c) through an orientation session or brochure to other students at the institution. SECTION 2. Makes this Act applicable beginning with the 1999 fall semester. SECTION 3.Emergency clause. Effective date: upon passage.
