SRC-DPW H.B. 2930 76(R) BILL ANALYSIS Senate Research Center H.B. 2930 76R8643 SRC-DBy: Walker (Duncan) Intergovernmental Relations 5/11/1999 Engrossed DIGEST Currently, Section 573.041, Government Code, prohibits a public official from hiring or appointing an individual who will be compensated directly or indirectly with public funds if the individual is related to the public official within the third degree by consanguinity or the second degree by affinity. Public officials in small incorporated municipalities, with populations of 200 or less, may have difficulty hiring employees that are not related within those degrees of relationship. This bill would provide that Section 573.041, Government Code, does not apply to an appointment or employment of a person by a municipality that has a population of less than 200. PURPOSE As proposed, H.B. 2930 provides that Section 573.041, Government Code, does not apply to an appointment or employment of a person by a municipality that has a population of less than 200. RULEMAKING AUTHORITY This bill does not grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 573.061, Government Code, to provide that Section 573.041, Government Code, does not apply to an appointment or employment of a person by a municipality that has a population of less than 200. SECTION 2. Makes application of this Act prospective. SECTION 3.Emergency clause. Effective date: upon passage.
