HBA-MPA, NLM H.B. 2961 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 2961 By: Jones, Delwin County Affairs 7/13/1999 Enrolled BACKGROUND AND PURPOSE Prior to the 76th Legislature, the commissioners court of Lubbock County had the authority to appoint the Board of Managers of the Lubbock County Hospital District. The purpose of this bill is to allow the Texas Tech University board of regents (regents) to appoint one member to serve on the board of managers. H.B. 2961 requires the regents to appoint one ex officio member to the board of hospital managers and the commissioners court to appoint the remaining members RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 8, Chapter 484, Acts of the 60th Legislature, Regular Session, 1967, to require the Texas Tech University board of regents to appoint one ex officio member and the commissioners court to appoint the remaining members of the board of hospital managers of the Lubbock County Hospital District. Requires that the appointed ex officio member have all powers of a member of the board, except that the member may not vote. Requires that the appointed ex officio member have access to all documents reviewed or considered by the board or its staff, and have any and all other powers of a member of the board with the exception of voting. SECTION 2. (a) Effective date: September 1,1999. (b) Provides that the change in law made by this Act relating to the composition of the board of hospital managers of the Lubbock County Hospital District does not affect the eligibility of a member serving immediately before the effective date of this Act to continue to serve on the board for the term to which the member was appointed. Requires the regents to appoint a member to the board of hospital managers in accordance with Section 8, Chapter 484, Acts of the 60th Legislature, Regular Session, 1967, as amended by this Act, to fill the next vacancy that occurs after the effective date of this Act. SECTION 3. Emergency clause.
