HBA-DMD C.S.H.B. 3045 76(R)BILL ANALYSIS Office of House Bill AnalysisC.S.H.B. 3045 By: Hunter State, Federal, & International Relations 4/16/1999 Committee Report (Substituted) BACKGROUND AND PURPOSE Four years ago, the Texas Department of Transportation transferred 44.07 acres of land to the General Services Commission to be used for the Texas State Cemetery (cemetery). A recent survey of the cemetery found that the original metes and bounds description of the land was recorded incorrectly. C.S.H.B. 3045 updates and corrects the metes and bounds recorded in the Government Code for the cemetery. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2165.256(b), Government Code, to replace the metes and bounds description of the State Cemetery . SECTION 2.Effective date: September 1, 1999. SECTION 3.Emergency clause. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B. 3045 modifies the original in the caption by stating that this bill is related to property dedicated to the State Cemetery, rather than related to the Texas State Cemetery Annex. This substitute differs from the original bill in SECTION 1 (Section 2165.256, Government Code), by modifying the metes and bounds description of the State Cemetery and by modifying the original bill to conform to Legislative Council format.
