HBA-MPM H.B. 3158 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3158 By: McClendon Public Education 3/26/1999 Introduced BACKGROUND AND PURPOSE Currently, the State Board of Education is authorized to appoint a board of three to five trustees for two-year terms for each military reservation school district. The majority of the trustees must be civilians, and all of the trustees may be civilian. There is a concern that most of the initial term of a new board member is spent simply becoming educated about the district. Additionally, the term for board members of other public independent school districts in Texas is typically three years. H.B. 3158 authorizes the State Board of Education to appoint trustees for two, three, or four-year terms in military reservation districts. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 11.352(b), Education Code, to require the list of persons qualified to serve as members of a military reservation school district board (board) of trustees and who live or are employed on the military reservation to be furnished to the State Board of Education, rather than the board, by the commanding officer of that reservation. Provides that trustees appointed serve terms of two, three or four years, as determined by the State Board of Education. SECTION 2.Emergency clause. Effective date: upon passage.
