However, the statutes contain no provisions for enforcement of regulations. H.B. 3191 makes violation of a county park rule a Class C misdemeanor. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter C, Chapter 320, Local Government Code, by adding Section 320.0455, as follows: Sec. 320.0455. RULES IN A POPULOUS COUNTY; PENALTY FOR VIOLATIONS. (a) Provides that this section applies to a county with a population of 2.8 million or more. (b) Authorizes the board of park commissioners (board), subject to the approval of the commissioners court, to adopt reasonable rules concerning the use of any park administered by the board. (c) Provides that a person commits a Class C misdemeanor if the person violates a rule approved by the commissioners court under Subsection (b). (d) Requires the deposit of fines collected under Subsection (c) in the county's general fund. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
