HBA-DMD H.B. 3220 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3220 By: Gallego Business & Industry 4/4/1999 Introduced BACKGROUND AND PURPOSE The International Labor Organization estimates the world-wide total of child laborers to be between 100 and 200 million. H.B. 3220 prohibits a person from selling a consumer good that is produced through the use of child labor unless the good is marked legibly in a conspicuous place to indicate to a consumer that child labor was used to produce the good. This bill establishes a penalty for violation of this provision. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter D, Chapter 35, Business & Commerce Code, by adding Section 35.55, as follows: Sec. 35.55. LABELING OF CONSUMER GOODS PRODUCED THROUGH USE OF CHILD LABOR. Defines "child," "consumer good," and "mark." Prohibits a person from selling a consumer good produced through the use of child labor unless the good is marked legibly in a conspicuous place to indicate to a consumer that child labor was used to produce the good. Provides that a person who violates this section commits a Class A misdemeanor. SECTION 2.Effective date: September 1, 1999. SECTION 3.Emergency clause.
