BACKGROUND AND PURPOSE 

Currently, a school district is not required to test the indoor
environmental quality of an instructional facility before using state funds
to renovate the building.  H.B. 3287 requires a school district to conduct
a survey, performed by an independent professional, of a facility's indoor
environmental quality before beginning a renovation project. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 46, Education Code, by adding Section 46.0081,
as follows: 

Sec. 46.0081.  SURVEY REQUIREMENT FOR RENOVATION PROJECTS. (a)  Prohibits a
school district from using state funds received under Chapter 46, Education
Code (Instructional Facilities Allotment), to pay for the renovation of an
instructional facility without first obtaining a copy of a survey that
analyzes the facility's overall indoor environmental quality. 

(b)  Provides that the survey required in Subsection (a) must be conducted
by an independent professional. 

SECTION 2.  Makes application of this Act prospective.

SECTION 3.  Effective date: September 1, 1999.

SECTION 4.  Emergency clause.
