HBA-NIK H.B. 3335 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3335 By: McClendon Licensing & Administrative Procedures 4/13/1999 Introduced BACKGROUND AND PURPOSE Currently, an employee of the Texas Lottery Commission and an independent certified public accountant must witness and validate each lottery drawing. The equipment is inspected immediately before and after each drawing. If the drawing is invalid, a new drawing occurs. Currently, there is no mechanism in place to inform the public if an announced lottery drawing has been invalidated and a new drawing has occurred. H.B. 3335 requires the Texas Lottery Commission to adopt rules requiring the commission to promptly notify sales agents and the news media when any lottery drawing is invalid and must be redrawn. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that rulemaking authority is expressly delegated to the Texas Lottery Commission in SECTION 1 (Section 466.401, Government Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 466.401, Government Code, by adding Subsection (d), to require the Texas Lottery Commission (commission) to adopt rules requiring the commission to promptly notify sales agents and the news media when any lottery drawing is invalid and must be redrawn. Requires notification under this subsection to be made in a manner that provides reasonable notice to the public. SECTION 2. Effective date: September 1, 1999. Makes application of this Act prospective. SECTION 3. Emergency clause.
