HBA-SEB H.B. 3350 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3350 By: Turner, Bob Pensions and Investments 4/1/1999 Introduced BACKGROUND AND PURPOSE Currently, state law does not require the Employees Retirement System of Texas (ERS) to issue refunds of contributions to its members within any particular time period, nor does it require ERS to track the amount of time it takes to process a contribution refund. H.B. 3350 requires ERS to track and compile information concerning all applications for withdrawal of contributions from the time an application is made until a warrant for a refund is issued. It also requires a statistical analysis of that information to be contained in an annual report that is submitted to the governor, lieutenant governor, speaker of the house of representatives, executive director of the State Pension Review Board, the appropriate oversight committees of the house and senate, and the Legislative Budget Board. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 812.102, Government Code, to require the Employees Retirement System of Texas (ERS) to adopt procedures to track and compile information of all applications filed under this section (Procedure for Withdrawal) from the time an application for a withdrawal of contributions is made until any warrant for a refund is issued by ERS. SECTION 2. Amends Section 815.510(a), Government Code, to require an annual report submitted by ERS to specific government officials and agencies to include a statistical analysis based on information compiled under Section 813.102. Makes a conforming change. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
