HBA-MPA C.S.H.B. 3351 76(R)BILL ANALYSIS Office of House Bill AnalysisC.S.H.B. 3351 By: Turner, Bob Transportation 5/5/1999 Committee Report (Substituted) BACKGROUND AND PURPOSE Recently, in high-growth counties there has been an increase in the number of property owners purchasing manufactured homes. The transportation of these homes can put a strain on county road infrastructure. Commissioners courts have expressed a desire for some type of notice informing them of the transportation of a manufactured home in the county, to aid better road planning. C.S.H.B. 3351 requires the Texas Department of Transportation to provide a county judge with a copy of the transportation permit for a manufactured home if it is to be used as a residence within the county, and requires the county to reimburse the cost of providing such notice. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 623.094, Transportation Code, by adding Subsection (c), to require the Texas Department of Transportation (TxDOT), upon request, to send a copy of each permit for the transportation of a manufactured house to the county judge in each county in which the transportation ends at a site where the manufactured house will be occupied as a residence. Requires the county to reimburse TxDOT for all costs associated with sending the county judge a permit under this subsection. SECTION 2.Emergency clause. Effective date: 90 days after adjournment. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B. 3351 differs from the original in SECTION 1 (proposed Section 623.093(c), Transportation Code), by adding language that specifies that a copy of the permit for the transportation of a manufactured house must be sent to the county judge of the county in which the transportation ends and where it will be occupied as a residence, rather than where it ends, as in the original bill. The substitute adds a provision that requires the county to reimburse TxDOT for all costs associated with sending the county judge a permit. The changes made by the substitute are given effect by adding a new Subsection (c) to Section 623.094, Transportation Code, rather than adding a new Subsection (f) to Section 623.093, Transportation Code, as proposed in the original bill.
