HBA-MPA H.B. 3445 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3445 By: Keel County Affairs 4/4/1999 Introduced BACKGROUND AND PURPOSE Currently, the law provides that a county with a population of 1.5 million or greater may implement a system for providing 9-1-1 service in the unincorporated areas of the county and may impose a service fee on local exchange telephone service customers in the area served. The fee must be in an amount reasonable to cover the costs of providing 9-1-1 service and revenue from the fee may be used only for the planning, development, and provision of 9-1-1 service. H.B. 3445 provides that Subchapter E, Chapter 772, Health and Safety Code, applies to a county having a population of more than 500,000. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 772.402, Health and Safety Code, to provide that this subchapter applies only to a county having a population of more than 500,000, rather than 1.5 million, in which a communication district has not been created under Subchapter B (Emergency Communication Districts: Counties with Population Over Two Million) or C (Emergency Communication Districts: Counties with Population Over 860,000). Effective date: 90 days after adjornment.
