HBA-DMD H.B. 3469 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3469 By: Olivo County Affairs 4/19/1999 Introduced BACKGROUND AND PURPOSE Legislation passed by the 75th Legislature, authorized a county with a population of 2.8 million or more or a public health district at least part of which is in a county that has a population of at least 2.8 million or more to recover at least 50 percent of its costs for reviewing and acting on permits, amending and renewing permits, and conducting inspections. Currently a county with a population of less than 2.8 million cannot require a fee that exceeds $150 for issuing or renewing permits. H.B. 3469 authorizes a county that has a population of at least 300,000 or a public health district at least part of which is in a county that has a population of at least 300,000 to require the payment of certain fees. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 437.0123(a), Health and Safety Code, to authorize a county that has a population of at least 300,000, rather than 2.8 million, or a public health district at least part of which is in a county that has a population of at least 300,000, rather than 2.8 million, to require the payment of a fee for issuing or renewing a permit or for performing an inspection to enforce this chapter or a rule adopted under this chapter. SECTION 2.Emergency clause. Effective date: upon passage.
