HBA-ALS H.B. 3546 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3546 By: Yarbrough Land & Resource Management 4/5/1999 Introduced BACKGROUND AND PURPOSE Under current law, a property owners' association has authority to modify and amend the existing restrictive covenants of a subdivision. There is a concern that changes made by these homeowner associations are often made without the knowledge or consent of the homeowners. H.B. 3546 repeals Chapter 24, Title 11, Property Code, which grants property owners' associations various powers relating to restrictive covenants in certain subdivisions. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Chapter 204, Title 11, Property Code (Powers of Property Owners' Association Relating to Restrictive Covenants in Certain Subdivisions). SECTION 2.Effective date: September 1, 1999. SECTION 3.Emergency clause.
