HBA-MPA H.B. 3569 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3569 By: Uher County Affairs 3/31/1999 Introduced BACKGROUND AND PURPOSE Currently, an elected county or precinct officer who is aggrieved by the setting of the officer's salary or personal expenses may request a hearing before the salary grievance committee before the approval of the county's annual budget. If six or more of the nine-member grievance committee vote to recommend an increase in the officer's salary or personal expenses, the grievance committee must submit the recommendation to the commissioners court. If six to eight members vote for the increase, the commissioners court must consider the recommendation. If all nine members vote for the increase, the commissioners court must adopt the recommendation of the grievance committee. H.B. 3569 requires that if five or more members of the grievance committee vote for the increase, the committee must submit its recommendation to the commissioners court in writing. If six or more members recommend the increase, the commissioners court must adopt the recommendation of the grievance committee. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 152.016, Local Government Code, to require a salary grievance committee, after conducting a hearing on request of an elected county or precinct officer who is aggrieved by the setting of the officer's salary or personal expenses, to submit in writing its recommendation to the commissioners court if five, rather than six, members vote to recommend an increase. Requires the commissioners court, if six or more, rather than six to eight, members vote to recommend the increase and sign the recommendation, to include the increase in the budget before it is filed. Provides that such an increase takes effect in the next budget year. Deletes provision calling for the commissioners court to consider the recommendation at its next meeting if supported by six to eight members, and to include it in the budget if nine members vote to recommend it. Effective date: 90 days after adjournment.
