BACKGROUND AND PURPOSE 

Current law states that a person may not cause, permit, or allow a public
nuisance on any premises. Examples of such nuisances include storing
rubbish on premises in open sight and maintaining the premises in a manner
that creates an unsanitary condition likely to attract or harbor
mosquitoes, vermin, or disease-carrying pests.  This law currently applies
only to an unincorporated area of a county with a  population of 125,000 or
more.  H.B. 3576 makes this law applicable to a county with a population of
80,000 or more. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 343.011(a), Health and Safety Code, to make this
section (regarding public nuisance in certain counties) applicable to an
unincorporated area of a county with a population of 80,000 or more, rather
than 125,000 or more. 

SECTION 2.  Effective date: September 1, 1999.

SECTION 3.  Emergency clause.
