HBA-KMH H.B. 3592 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3592 By: Danburg Elections 3/26/1999 Introduced BACKGROUND AND PURPOSE H.B. 3592 requires a person making contributions that in the aggregate exceed $25,000 in a calendar year to all candidates, officeholders or political committees or any combination thereof to report to the Texas Ethics Commission all contributions made in that calendar year. This bill also makes it a Class A misdemeanor if the person fails to comply with this section. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Chapter 254, Election Code, by adding Subchapter J, as follows: SUBCHAPTER J. REPORTING BY INDIVIDUALS Sec. 254.261. REPORTS BY INDIVIDUALS. (a) Requires a person making contributions that in the aggregate exceed $25,000 in a calendar year to all candidates, officeholders or political committees or any combination thereof to report to the Texas Ethics Commission (commission) all contributions made in that calendar year. (b) Provides that each report required by this section must include the amount of the political contribution, full name and address of the candidate, officeholder or political committee receiving the contribution, and the date of the contribution. (c) Provides that it is a Class A misdemeanor if the person fails to comply with this section. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
