Currently, a navigation district having within it a city with a population
of over 250,000 has the authority to exchange land or interest in land with
other landowners. H.B. 3620 would extend that authority to any navigation
district.
PURPOSE
As proposed, H.B. 3620 sets forth requirements for the exchange and
conveyance of lands by certain navigation districts.
RULEMAKING AUTHORITY
This bill does not grant any additional rulemaking authority to a state
officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 1, Article 8247f, V.T.C.S., to require the
governing board of a navigation district to have the authority to exchange
lands with any other public or private land owner, to make conveyance to
another state or federal governmental entity, person, firm or corporation
of lands owned and held by the navigation district, in accordance with any
terms, conditions, or stipulations agreed on by the parties to the exchange
or conveyance. Deletes text regarding a population of two hundred and fifty
thousand.
SECTION 2. Provides that SECTION 1 of this Act certain limitations or
conditions and Sections 61.116 or 61.117, Water Code.
SECTION 3. Emergency clause.
Effective date: upon passage.
